<br />6.4.19 EXHIBIT S -Permanent Man-Made Structures <br />21. The applicant has identified a number of significant, valuable or permanent man-made structures <br />located within two hundred (200) feet of the affected land. The applicant has committed to staying at leas[ <br />200 fee[ away from such structures until compliance with the requirements of Rule 6.4.19 are met. (This <br />includes tailwa[er ditches, utilities, county roads, gas lines, pipelines, gas wells, and oil appurtenances). In <br />[he event [ha[ [he applicant desires [o provide a notarized agreement or stability analysis for any mining to <br />occur within 200 feet of a structure after the June I8, 2001 decision date, such information will need to be <br />submitted as a modification (technical revision or amendment) to the permit. In the event the applicant <br />submits a stability analysis on or before the June 8, 2001 adequacy review response date, the Division may <br />consider such information [o be a revision to the application and may revise the current June 18, 2001 <br />decision date. In [he event the applicant submits a stability analysis for mining within 200 feet of the gas <br />pipeline separating Cells 3 & 4 line and/or the gas line separating Cells- 2 & 3, the applicant will need to <br />include engineering designs and plans for pressure equalization between the cells or riprap armoring of the <br />lateral berms separating the cells. (This would be required since the gas line is located within the <br />floodplaitt of the Big Thompson River and the berm width covering the gas line would be less than 400 <br />feet). Please verify. <br />22. Exhibit S should be revised to include the following structures and owners: a) gas & oil appurtenance <br />in the northwest corner of [he permit area, owned by Public Service Company of Colorado; b) gas line <br />between Cells 2 & 3 owned by Machi-Ross Petroleum Company; and c) tailwa[er ditches bordering Cells 3 <br />& 4 and the potential 13.9 acre wetland mitigation area. Please address. <br />Once again, I will look forward to your response on or before June 8. 2001 [o allow adequate time for <br />review before the June 18, 2001 decision date. Rule 1.8.1 states that changes and additions to the permit <br />application must be filed with the Division and the County Clerk and Recorder. The applicant must also <br />provide the Division with an affidavit or receipt demonstrating [ha[ [he change or addition was filed with <br />the County Clerk and Recorder no later than the close of business on the day the change was filed with the <br />Division.
