Long <br />Divivon Dnector <br />Listed below are adequacy review comments on the above-captioned Regular 112 Application for 210 <br />permitted acres located within Weld County. The decision date for your application is scheduled for June <br />I8, 2001. Therefore, I would appreciate a response from you on or before June 8, 2001. Please be advised <br />[ha[ your application may be deemed inadequate ttnd may be denied on June 18, 2001 unless [he following <br />adequacy review items are addressed to [he satisfaction of [he Division. If additional time is needed to <br />prepare and submit an adequacy response, the applicant may waive their right to a decision within 90 days <br />and request an extension of time. However, such request must be made in writing and will need to be <br />received by the Division on or before June 8,2001. <br />6.4.3 EXHIBIT C -Pre-minine and Minine Plan Maas) of Affected Lands <br />I. The mining plan map provided indicates mining will occur within 200 feet of a number of pennanen[ <br />man-made structures. For clarification, [he Division considers [he applicant's commitment in Exhibit S of <br />the application to supercede the information portrayed on the mining plan map. In Exhibit S, the applicant <br />provides a commitment to stay a[ least 200 feet away from all permanent man-made structures until such <br />time that a) the applicant provides a notarized agreement between the applicant and the person(s) having <br />an interest in the structure, that [he applicant is to provide compensation for any damage to the structure, or <br />b) where such agreement cannot be reached, the applicant will provide an appropriate engineering <br />evaluation that demonstrates that such structure shall not be damaged by activities occurring at the mining <br />operation. Please verify. <br />6.4.4 EXHIBIT D -Minine Plan <br />2. The applicant lists on page 2 (item 13.2) of [he application form the following items to be used or stored <br />within the permit area: diesel fuel, grease, hydraulic fluids, concrete additives, and cement. The Division <br />requests that the applicant clarify which of the items mentioned above will be stored on site, whether they <br />will be stored outside of the floodplain of [he Big Thompson River, and what protection measures will be <br />used to ensure their capture in the event of a leak or spill. Any protective berms to be used should be <br />adequate to contain 10090 of the volume of stored material. (The Division recommends [hat the storage <br />area(s) be located outside the floodplain. If it becomes necessary for the applicant to have one or more <br />
