Mined Land Reclamation Pa?e 2 <br />March 3, 1983 <br />The Mesa County Rzsolution that was inserted in the mining application stipu- <br />lates that pit water should be pumped into the DeRequc pond iF its water table <br />is being lowered by the mining, operation. D~.iring periods of call on the river <br />basin, Corn cannot 1zgaLly diver[ canter to this pond unless the pond inns a <br />senior adjudicated water right that alloeas this diversion. Our office will <br />order Corn to cease any illegal diversion such as this. <br />The Larkin Ditch flows immediately adjacent to the east side of the permit <br />area. The application states that the ditch is at present perched above the <br />gravel deposit and above the water table in thz gravel deposit. Because of <br />this, Corn does not anticipate that decaatering will have any effect upon the <br />ditch. While this statement may be correct, we believe that Corn should meet <br />with the owners of the Lar•cin Ditch to mitigate Chzir concerns. Parshall <br />flumes could be installed before the ditch nears the Hermit area and aater it <br />leaves the area to measure any change in ELo~a that might occur due to <br />increased seepage. <br />In conclusion, we do not recommend approval of this application until Corn <br />addresses the issues raised in this letter. Further, we will order the appli- <br />cant to cease operations if excavation begins without the required•well per- <br />mit.
