The issuance of the <br />permit does not assure the applicarn that no injury will occur to another vested water right or preclude another <br />owner of a vested water right from seeking relief in a civil court action. <br />2) Well pertnR denial file AD-11979 reconsidered and approved pursuarn to CRS 37-90-137(2) and the decree granted <br />for Peabody Seneca It-W We{{ No. 1 in case nos. 89CW62 and 89CW63, Division 6 Water Court. The operation of <br />this well is subject to the terms and conditions of said decrees. <br />Approved for the use of an existing structure, a well constructed in the fall of 1988 as a monitoring and test hole. <br />4) The maximum pumping rate shall not exceed 35 GPM. <br />The average annual amount of ground water to be appropriated shall not exceed 56.5 acre-feet. <br />The use of ground water from this well is limited to industrial purposes in a coal mine operation, including but not <br />limited to dust cornrol and drinking and sanitary facilities in the mine offices and shops. <br />Production is limited to the Trout Creek Sandstone of the Iles Formation. Plain casing must be installed and sealed <br />to prevern the withdrawal of ground water from other aquifers and the movemern of ground water between aquifers. <br />A totalizing flow meter must be installed on the well and mairnained in good working order. Permanent records of <br />all diversions must be maintained by the well owner (recorded at least annualy) and submitted to the Division <br />Engineer upon request <br />The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court <br />case number(s) as appropriate.
