The legal description for the location of the well is: <br />SW 1/4, NW t/4, Section 22, TSN, R88W, 6th P.M., at a point <br />1720 feet from the North section line and 550 feet from the 'Rest <br />section line <br />4. The source of the water is: <br />Trout Creek Sandstone formation, tributary to Sage Creek <br />5. The depth of the well is: <br />760 feet <br />6. The date of appropriation is: <br />11/14/1988 <br />7. The appropriation was initiated by: <br />Drilling an exploratory hole, setting well casing ana testing <br />the well for aquifer characteristics <br />8. The amount of water awarded is: <br />x.078 c.f.s, (35 g.p.m.), Conditional <br />9. The use of. water is: <br />Domestic purposes including water used by employees for <br />drinking, washing and sanitary uses, and for industrial purposes, <br />primarily dust suppression. <br /> <br /> <br />10. The Applicant filed an application for a permit to use ground <br />water with the Colorado State Engineer in connection with the same <br />well which is the subject of the present conditional water rights <br />application. In File No. AD-11979, the State Engineer denied the <br />Applicant's request for a permit. The State Engineer based his <br />denial on his conclusions that (1) the well is to be completed in <br />the Trout Creek Sandstone member of the Iles Formation, which is <br />hydraulically connected with Sage Creek, (2) Sage Creek is <br />overappropriated and at some or all times of the year the avatar <br />supply for Sage Creek is insufficient to satisfy all of the decreed . <br />water rights senior to the app nsprt3t;Cn the :Gp1iC3nt seeks, and <br />(3) the proposed diversion would cause depletion to Sage Creek at <br />times when it is overappropr~ated. <br />16-1-18 <br />
