Permit Date: January 5, 2004 <br />PennitNo: M-1987-113 <br />The following additional stipulations and conditions form an integal part of the foregoing permit: <br />Stipulation No. Description <br />1 A reportable spill is a spill of any toxic or hazardous substance (including spills of <br />petroleum products) within the mined land permit area reportable to any Division of the Colorado <br />Department of Public Health and the Environment, the National Response Center, the Colorado Emergency <br />Planning Commission, any local Emergency Planning Commission, local Emergency Planning Committee, <br />or the State Oil Inspector. The Mine Operator shall notify the Division of Minerals and Geology (DMG) of <br />a reportable spill within the mined land permit area using the same timeframe required by the permit, <br />license, notice, statute, rule or regulation govering the reporting of the spill to the other appropriate agency. <br />Notice of a reportable spill shall be FAXed to: Minerals Program Supervisor, Division of Minerals and <br />Geology, FAX (303) 832-8106. The FAX shall include acall-back number of a responsible company <br />official for DMG staff to use as a contact. <br />2 The operator will submit an acreage reduction revision to the application deleting that <br />portion of the original permitted area that is now included in the Bluestone Pit, File M-1991-035, more <br />specifically described as west i/4 Section 9, Township 2 South, Range 70 West of the 6th P.M. in Jefferson <br />County, Colorado. <br />3 The applicant will submit a technical revision(s) to the application addressing and/or <br />updating the following exhibits or sections of the permit application: (a) Mining Plan--address reclaimed <br />slopes, depth of mining, topsoil salvage and replacement; (b) Revegetation--update seed mix, submit new <br />weed control plan; (c) Maps--provide updated location, mining, and reclamation plan maps incorporating <br />the various changes to all other exhibits; (d) Hydrology--revise as necessary to address groundwater <br />exposure issues; (e) Wildlife--provide or update information as necessary to address any changes that have <br />occurred since application approval. <br />No mining shall occur on the site until this revision(s) is submitted and approved by the division.
