Jc) DEPARTMENT OF NATURAL RESOURCES
~{ a ~ ~ Davitl H. Getches. Eaecu[ive Director
,8 6 MINED LAND RECLAMATION DI1
DAVID C. SHELTO N. Director
Richartl D. Lamm
Governor
County, City, and Town Zoning
MEMORANDUM
DATE: February 12, 1986
T0: Pueblo County Planning Department
10th & Main, Box 878
Pueblo, CO 81003
FROM: Mark S. Loy_e, Senior Reclamation Specialist
Pursuant to the requirement of the Colorado iAined Land Reclamation Act* to
inform counties and certain municipalities of mining and reclamation permit
applications filed with this office, please know that Valco Pueblo Concrete
Division has filed to conduct surface mining at or near Section 34.0, Township
20.0 S, Range 64.0 W, 06th Prime Meridian. The applicant proposes to reclaim
the site for recreation.
The Mined Land Reclamation Board must deny a permit for any proposed mining
operation which would be in violation of zoning, subdivision regulations or
any master plan for extraction (See CRS 34-32-115(4)(e)). Similarly, the
Board can not grant a permit fora new mining operation if the operator's
reclamation plan for an area is inconsistent with an adopted plan by any
county, city and county, city, or town unless a prior declaration of intent to
change or waive the prohibition is obtained by the applicant from the affected
government subdivisions (See CRS 34-32-109(8)). Please return the enclosed
form to provide this critical information.
The applicant is required to place a copy of the application for public
inspection with the Clerk of the county in which the proposed mine is
situated. This is intended to provide the application for public review and
comment. Please note that it is not intended to be made apart of public
record by recording.
The Board is tentatively scheduled to consider this application on April 23,
1986.
We appreciate your cooperation in this matter. If you have any questions,
please call.
* Arttc e o Ttt a Co orado Revise Statutes, as amended.
Enclosure
/bdc
7370E
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
