Cottony <br />Division Director <br />Natural Resource Trustee <br />The Division has received your submittal of a Notice of Intent for coal exploration for the <br />National King Coal, LLC, and it has been given the designation CX-2006-216-02. The <br />Division has made the following findings: <br />1. The application is incomplete. <br />2. The project qualifies as coal exploration rather than coal mining. <br />3. The proposed project will substantially disturb the natural land surface. <br />Therefore you will be required to submit reclamation plan and a bond to cover the <br />cost of the proposed reclamation. <br />With regard to the reclamation, Rule 4.07.3 requires that after use, entries by "capped, <br />sealed, backfilled or otherwise properly managed as required by the Division and <br />consistent with 30 CFR 75-1711. The referenced federal regulation states requires that <br />slope or drift openings be sealed with "solid, substantial, incombustible material, such as <br />concrete blocks, bricks, or the or shall be completely filled with incombustible material <br />for a distance of at lest 25 feet into such openings." In addition to the portals, a plan will <br />be required for reclamation of the road used to access the portals and transport any waste <br />material. In addition, information is needed on the dimensions of the portals and the <br />road for the purpose of calculating the bond. <br />The Division has notified the Mine Safety and Health Administration of the proposed <br />work in the sealed mine and will notify you if they provide any additional comments. <br />Office of Office of Colorado <br />Mined Land Reclamation Active and Inactive Mines Geological Survey <br />
