The Division has received your submittal of a Notice of Intent for coal exploration for the
National King Coal, LLC, and it has been given the designation CX-2006-216-02. The
Division has made the following findings:
1. The application is incomplete.
2. The project qualifies as coal exploration rather than coal mining.
3. The proposed project will substantially disturb the natural land surface.
Therefore you will be required to submit reclamation plan and a bond to cover the
cost of the proposed reclamation.
With regard to the reclamation, Rule 4.07.3 requires that after use, entries by "capped,
sealed, backfilled or otherwise properly managed as required by the Division and
consistent with 30 CFR 75-1711. The referenced federal regulation states requires that
slope or drift openings be sealed with "solid, substantial, incombustible material, such as
concrete blocks, bricks, or the or shall be completely filled with incombustible material
for a distance of at lest 25 feet into such openings." In addition to the portals, a plan will
be required for reclamation of the road used to access the portals and transport any waste
material. In addition, information is needed on the dimensions of the portals and the
road for the purpose of calculating the bond.
The Division has notified the Mine Safety and Health Administration of the proposed
work in the sealed mine and will notify you if they provide any additional comments.
