.. <br /> <br />- Letttr of Agreement <br />between the <br />Colorado Alined Land Reclamation Division <br />and <br />Pueblo Loal, Inc. <br />I. Introduction <br />Pueblo Coel Inc. (the operator) and the Colorado pivision of Mined Land <br />Reclamation (the Division} hereby enter Into the following agreement in regard <br />to contlnuatton of the review time period for renewal of Permit C-87-054 for <br />the Carbon Junction Mine beyond the 180 day timeframe specified in Section <br />119(2) of the Colorado Surface Coal Mining Reclamation Act fACt). Violation <br />of the timetables or conditions set forth below will constitute sufficient <br />reason for the Division to 0o forward with a recommendation to deny the <br />renewal application or the applicant to Detltion the Mined Land Reclamation <br />Board (the Board) fora hearing on the issues. <br />II. Conditions <br />A. By June 1, 1990, the operator will submit to the Division an <br />acceptable replacement bond or rider to the current bond, <br />increasing the reclamation bond amount to b1,125,300.00 or such <br />amount as agreed to by the parties to ensure reclamation of the <br />site. <br />B. The operator will continue to perform maintenance and monitoring at <br />the Carbon Junction lAine as required by the Dermlt and regulations. <br />C. By December 11, 1989, the operator will submit to the Division <br />Annual Hydrologic Report (AHR) for the 1986, 1987, 1988 and 1989 <br />water years. The reports will Include all reduced and tabulated <br />hydrolooic data collected during each year, as well as an <br />interpretation of the data and a discussion of any trends or <br />impacts to the hydrologic system. In addition, an updated probable <br />hydrolooic Consepuences evaluation based on observations made and <br />data collected since permit issuance will be submitted. <br />D. By June 1, 1990 the operator will submit to the Division all <br />Information necessary for the Division to render a decision on the <br />permit renewal. <br />E. The operator will rtot conduct mining operations and no additional <br />surface disturbance tpther_than-rou ne maintenance required to <br />maintain the site in Cp`liance~will.occur at the site until a <br />decision on the permit renewal~is rendered by the Dl vision . <br />`I/ <br />I <br /> <br />
