<br />DEVELOP?PENT AND E1{TRACTION MINING PERMIT
<br />THIS PERMIT is issued this 11th day of Sept. 1980 by the :tined Land
<br />Reclamation Board, Department of Natural Resources, State of Colorado.
<br />W I T N E S S r T H
<br />WHEREAS, BACA COUNTY desires to conduct a(n) open 3ir.ing
<br />cperation, known as Pit ~,8 for the purpose of extracting open
<br />mined sand and gravel.
<br />:vY.EREAS, on October 13 , 1977 BACA COUNTY "FILED" an
<br />application,a reclamation plan and map, and the required fee, as required by law; and
<br />WHEREAS, on July 23 1980 , the Mined Land Reclamation Board 2pproved
<br />Baca County' s application and set bond; and
<br />GdEP.F.~_S, on September 11, 1980 , the `?fined Land Reclamation Board accepted
<br />surety submitted by BACA COUNTY and such date shall be considered the
<br />date of issuance of the permit and the anniversary date for all other purposes; and
<br />!THERE_~S, the ;fined Lana Reclamation Eoard has made a finding, for the purposes
<br />of issuing this permit, that:
<br />1) the application complies with the reeuirements of the Colorado
<br />Mined Land Reclamation Act and all applicable local, state and
<br />Federal laws; and,
<br />2) the operation will not adversely affect the stability of anv
<br />significant, valuable, and permanent man-made structures located
<br />within two hundred feet of the affected land, except where there
<br />is an agreement between the operator and the persons having an
<br />interest in the structure that damage to the structure is to be
<br />compensated for by the operator; and,
<br />3) the proposed mining operations and reclamation can be carried out
<br />in conforaance with the requirements of C.R.S. 1913, 3w-32-116, as
<br />amended (1976 Sess. Laws H.3. 1060 ; and
<br />'.~dEREAS, for the purposes of issuing this permit, the operator hzs made a
<br />satisfacto r~ shoving to the Beard thaC he will eaploy duri::g and after his
<br />open mining operations procedures reasonably designee to minimize
<br />as such as practicable the disruption from the open mining operations
<br />ar.d ;gill provide for toe rahabilitation of the affected land through the rehabilitation
<br />cf plant cover, soil stabilit;~, water resources, ana other measures appropriate to tie
<br />subsequent beneficial use of such mined and reclaimed lands; and that in the e~~e^.t
<br />of the failure of his proposed reclamation plan, he will take whatever measures xhich
<br />ay be necessary in order to assure the success of reclamation of the lands affected
<br />by his open mining operations; and,
<br />STFi°_~?S, for the purposes of issuing this ne riit, a copy of the application
<br />approved by the Mined Land Reclamation Board of the State of Colorado is attached
<br />to this permit and thereby beccmes a part of the terms hereof.
<br />?:CSi, THEREFORE, pursuant to the authority set for*_h in the Colerzdo `?iced
<br />Land Reclamation Act, Ar icle 32 of Iitle 34, C.R.S. 1973, as amended, (1976
<br />Sess. Laws H.3. 1060 the `+-nod Land Reclamaticn Board of the Stata of Colorado
<br />Hereby issues a life of ,.he mine permit to BACA COUNTY to engage
<br />'-~ open mining for the purpcse of extracting open
<br />mined sand and gravel on the fo1'-owing parcel of ground, to wit:
<br />NWT SW~ of Section 8, Tocanship 34 South, Range 48 [nest of
<br />the 6th Principal Meridian in Baca County, Colorado.
