s • iii iiiiiiiiiiiii iii
999
M e m o r a n d u m
TO: JKW
FROM: MAN
RE: Panhandle Drilling Company 404 Permit
DATE: 19 April, 1985
I spoke this morning with Greg Moore, a civil engineer wit the
Army Corp. of Engineers, concerning the Panhandle mining ermit
application. My question to him was whether a 404 Permit would
be required when Panhandle dredges the headgate on the upper
reservoir as requested by Colorado Division of Wildlife.
According to Greg, 404 permits are not required when "re ving
material for maintenance purposes." A problem would arise if a
high degree of turbidity was created by the dredgin I
explained that the headgate flowed into an irrigation ditch only
and the headgate would most likely be closed at the tim the
dredging took place. The material that is removed may t be
placed back into the reservoir nor placed below the average flood
level for the reservoir.
He concluded that Panhandle will not be required to obtain 404
permit when dredging the upper reservoir and that we could
proceed with the plans to dredge. If, for some reason, the Corp
receives a complaint about the dredging and an investigati n is
initiated, Greg said he would be happy to vecify our
conversation.
Greg Moore
Civil Engineer
Army Corps of Engineers
Platte River Residence
979-4120
MAN:bg
