s • iii iiiiiiiiiiiii iii <br />999 <br />M e m o r a n d u m <br />TO: JKW <br />FROM: MAN <br />RE: Panhandle Drilling Company 404 Permit <br />DATE: 19 April, 1985 <br />I spoke this morning with Greg Moore, a civil engineer wit the <br />Army Corp. of Engineers, concerning the Panhandle mining ermit <br />application. My question to him was whether a 404 Permit would <br />be required when Panhandle dredges the headgate on the upper <br />reservoir as requested by Colorado Division of Wildlife. <br />According to Greg, 404 permits are not required when "re ving <br />material for maintenance purposes." A problem would arise if a <br />high degree of turbidity was created by the dredgin I <br />explained that the headgate flowed into an irrigation ditch only <br />and the headgate would most likely be closed at the tim the <br />dredging took place. The material that is removed may t be <br />placed back into the reservoir nor placed below the average flood <br />level for the reservoir. <br />He concluded that Panhandle will not be required to obtain 404 <br />permit when dredging the upper reservoir and that we could <br />proceed with the plans to dredge.
