3. Proposed Groundwater Exposure and Stormwater Condition. Objectors request a <br />condition prohibiting the exposure of groundwater during mining and requiring Allen to comply <br />with state water law requirements concerning the management of stormwater. Objectors have <br />provided no basis for such a condition. <br />In its application, Allen specifically stated that its operations will be designed to not <br />expose groundwater (Exhibit G to Allen Application). In its response to the DMG's fast <br />adequacy review, Allen again emphasized that it will not expose groundwater, stating that <br />"[m]ining will occur to 10 feet or within two feet of groundwater, whichever is shallower." See <br />April 14, 20061etter from Angela Bellantoni to Kate Pickford, DMG (Exhibit 35, p. 1). Upon <br />MLRB's approval of Allen's permit, Allen is obligated to comply with these provisions of its <br />approved mining plan. <br />Allen has also cleazly recognized its obligation to manage stormwater in a manner <br />consistent with Colorado water law. See Exhibit 35, p. 2. (acknowledging that stormwater will <br />not be retained for more than 72 hours). Objectors' request that additional conditions be <br />included in Allen's permit requiring Allen to do what it has already committed to do, and is <br />otherwise required to do by other state regulatory programs is senseless and beyond the <br />jurisdiction of this Boazd. <br />4. Water Oualitv Impact Condition. Objectors request that Allen's permit approval <br />be conditioned upon a requirement that no fuel or chemicals will be stored at the site, and that <br />Allen comply with Colorado Department of Public Health and Environment ("CDPHE") <br />requirements concerning stormwater management. <br />Again, Objectors' requested condition is fully addressed by Allen's mining plan and <br />other regulatory requirements that will independently apply to Allen's operation.
