("Allen"), by and through its attorneys, <br />Temkin Wielga Hardt & Longenecker, LLP, submits the following Opposition to Objectors' <br />Robert White's, Kent Rolf's, Curt Sayer's and Fred Wisely's ("Objectors") Motion for <br />Conditions ("Motion"). <br />In their Motion, Objectors request that the Mined Land Reclamation Board ("Board") <br />condition its approval of Allen's Section 112 reclamation permit with seven categories of <br />conditions. Objectors have not provided any defensible basis for imposing these conditions. In <br />many instances, Objectors rely on erroneous and unsupported factual accusations. Several of the <br />requested conditions aze beyond the jurisdiction of this Board, and attempt to usurp regulatory <br />programs implemented by other agencies.
