This recommendation is based on a finding by DMG that the applicant has <br />demonstrated compliance with the requirements of Section 34-32.5-115(4) of the Colorado <br />Mined Land Reclamation Act for the Extraction of Construction Materials. <br />Pursuant to the proposed Pre-hearing Order, the issues to be considered are limited to <br />floodplain issues, flood danger issues and water quality issues, including pit contamination <br />and heavy metals dislodged by the mining operation. Staff considered such issues during <br />the review period for the permit application and addressed them in its original Rationale for <br />Approval Recommendation, dated May 8, 2001, and during the May 23, 2001 hearing, and <br />in correspondence addressed to Ms. Marilyn Boynton subsequent to the hearing. Pursuant <br />to the Court Order for Case No. 01 CV3425, staff has re-reviewed the Line Camp Pit <br />application and finds no grounds for changing its original recommendation for approval. <br />
