Simpson, Assistant State Engineer <br />SUBJECT: Brannon Sand and Gravel -Pit 29 - #80-183 <br />Application for Mining and Reclamation Permit <br />As requested by your office, we have reviewed the application for a gravel <br />pit near Henderson. The applicant shows on the information provided that <br />a residential and commercial industrial area will be developed around the <br />reclaimed lakes. It would appear that the lakes will have both recreation <br />and wildlife use when they are reclaimed, We view this use of gravel pit <br />water as putting the ground water to a beneficial use which would thus <br />make the pit a "well". In order to construct the "well", a well permit <br />must be obtained so that the applicant avoids being in violation of CRS 1973, <br />37-90-137. We may have to order the applicant to ease operations if our <br />Water Commissioner determines that they have begun constructing the "well" <br />without a well permit. <br />In order to obtain a well permit, the applicant must provide an augmentation <br />plan that replaces the evaporation losses that will occur with this operation <br />to prevent alteration of the prevailing hydrologic balance of the critically <br />over-appropriated South Platte River basin, <br />~A. <br />Hal D.
