• <br />Section 816.97(b) Continued. <br />any critical habitat of a threatened or endangered species listed by the <br />Secretary, any plant or animal listed as threatened or endangered by the <br />State, or any bald or golden eagle, of which that person becomes aware <br />and which was not previously reported to the regulatory authority by <br />that person. <br />As described in Section 779.20, no critical habitat for any threat- <br />ened or endangered species was identified within the Mine Plan or <br />adjacent areas. Through the close company/agency coordination des- <br />cribed in paragraph (a) above, any critical habitat that is later <br />identified will be promptly reported to the regulatory authority. <br />A Golden eagle nest exists approximately two miles west of the Rerr <br />Mine Area, bu[ none exists in the permit area. Johnny darters have <br />been found in the Illinois River west of the Kerr Tipple Area but <br />• none are known to occur on the Tipple Area. Other sitinga of <br />eagles and Johnny darters will be reported to the regulatory au- <br />thority. <br />(c) A person who conducts surface mining activities shall ensure that <br />the design and construction of electric power lines and other trans- <br />mission facilities used for or incidental to the surface mining acti- <br />vities on the permit area are in accordance with the guidelines set <br />forth in Environmental Criteria for Electric Transmission System (USDI, <br />USDA (1970)), or in alternative guidance manuals approved by the regula- <br />tory authority. Distribution lines shall be designed and constructed in <br />accordance with REA Bulletin 61-10, Powerline Contacts by Eagles and <br />Other Large Birds, or in alternative guidance manuals approved by the <br />regulatory authority. For informational purposes, these two documents <br />are available at the OSM Office, U.S. Department of the Interior, South <br />Interior Building, Washington, D.C. 20240, at each OSM Regional Office, <br />District Office, and Field Office, and at the Central Office of the <br />applicable State regulatory authority, if any. <br />816-112 <br />
