Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining and Safety has finished the review of the above referenced 110c <br />application. It appears that Dirt Merchants Construction has met the requirements for issuance of a 110c <br />permit for construction materials. Therefore, staff is pleased to inform Dirt Merchants that the Wells Pit <br />Permit is approved. <br />Staff calculations for the Financial Warranty based on current conditions and proposed reclamation <br />plans estimate the costs to be $9,804.00. Dirt Merchants has accepted this estimate. Currently the <br />Division holds a bond of $7500.00. Dirt Merchants can elect to post and additional bond of $2304.00 or <br />one for the new total amount whichever itprefers. Please note that the permit is not officially active until <br />the bond has been accepted by the Division. <br />With the approval of the permit application, Dirt Merchants has met the requirements of the Mined Land <br />Reclamation Board Order from June 14, 2006. Civil penalties in the amount of $51,566.40 are hereby <br />waived with the exception of $566.40. Please submit a separate payment of $566.40 to complete the <br />process. The Cease and Desist Order will be lifted upon acceptance of the bond and civil penalty <br />payment.
