ASSIGNMENT OF SU3LEASE
THIS ASSIGNMENT, made as of the 31st day of March, 1983, by SENECA COALS,
LTD., ("Assignor"), a joint venture consisting of WESTERN UTILITY CORPORATION, a
Colorado corporation, and PEABODY COAL COMPANY, a Delaware corporation, to
PEABODY COAL COMPANY, ("Assignee"), a Delaware corporation;
WHEREAS, by a certain Sublease of Coal Leases, dated May 22, 1975, ("Sublease"),
Material Service Corporation subleased to Assignor rights in a certain Coal Lease
("Federal Lease") from the United States of America which bears serial number C-
01251; and
WHEREAS, Assignor desires to assign and quit claim to Assignee all of Assignor's
rights and interests in and To the Federal Lease;
• NOW THEREFORE, for good and valuable consideration, the receipt and suffi-
ciency of which is hereby acknowledged, Assignor does ASSIGN, TRANSFER AND OUIT
CLAIM to Assignee, and to its successors and assigns, forever, all Assignor's right, title
and interest in and fo the Federal Lease which embraces the following described real
property in Routt County, Colorado:
