It has been draining into <br />- Trail Greek since that time, even in winter, as the included photos show. It is located <br />several hundred yards up Trail Creek, in a wooded thicket across the creek from the <br />road, before you reach the first house on the right. As you can see, the drainage from <br />the edit was continuing even during the winter. <br />For some years AI and his son Dave have been operating another mine, which they <br />call the Comstock, but which I understand is actually the Little Albert Claim, without <br />any kind of permit. It is located on the hill across Trail Creek Road from the Phoenix, up <br />on the bank out of sight of the road. <br />The Mosches have been operating a dump at the site of the Comstoek/Little Albert <br />for the disposal of their household, mine and tourist operation waste. You may also find <br />a number of plastic buckets of human excrement stored at that sRe. <br />-- During the winb:r.ot 1997198, there wasatuel..oil spill of several hundrad_ _ <br />gallons from one of the tanks at the Phoenix Mlne into the area below the bank where his <br />tanks are located. This was reported io the Clear Creek Sheriff's office who notified AI, <br />but didn't bother to notify any HAZMAT personnel, This spill was covered with dirt. <br />This happened when AI's wife worked for the Sheriff's department. Just a coincidence, <br />I'm sure. It is easy to locate the site of this spill, as rt has seeped through and is visible <br />at the surface. <br />There is also a considerable amount of spilled fuel oil on the ground below the <br />tanks. <br />Many residents of the area would like to see the Moseh family start complying <br />with the laws which others are required to obey. <br />I understand that if the state does not force compliance of these regulations, it is <br />possible to sue in federal court to force compliance.
