<br />20. The feasibility of the proposed drainage plan for the reclaimed surface (two shallow <br />retention basins sloping toward center of site) will depend on the slope of the pit floor and <br />grading of topsoil and subsoil during reclamation. After phase 1 mining is completed, and <br />during subsequent phases, the feasibility of the drainage plan will be evaluated and modified if <br />necessary. Modifications which BI.M may consider include allowing runoff to exit the <br />reclaimed site or containing runoff behind retention dams or berms. Any runoff contained by <br />dams or berms must be designed to avoid pooling or concentrating water against the retention <br />structure. <br />2l. The operator shall immediately bring to the attention of the Grand Junction Resource Area <br />Manager any and all antiquities or other objects of historic or scientific interest including, but not <br />limited to, historic or prehistoric ruins, artifacts, or fossils discovered as a result of operations <br />under this permit. The operator shall inunediately suspend all activities is the area of the object <br />and shall leave such discoveries intact until told to proceed by the Area Manager. Notice to <br />proceed shall be based upon evaluation of the cultural significance of the object. Evaluation <br />shall be by a qualified professional selected by the Area Manager from a Federal Agency insofaz <br />as practical. When not practical, the operator shall follow the mitigation requirements set forth <br />by the Area Manager concerning protection, preservation, or disposition of any sites or material <br />discovered. In those situations where the Area Manager determines that data recovery and/or <br />salvage excavation aze necessary, the operator shall bear the cost of such data recovery and/or <br />salvage operations. <br />22. All operations shall be conducted to industry standards aztd in a safe manner. The area of <br />operations and all equipment, fuel, and lubricants shall be maintained in a clean and orderly <br />fashion and disposed of as required bylaw. No trash or hazardous materials shall be stored <br />within the permitted azea. The only hazazdous material on site would be refined petroleum <br />products which shall adhere to the applicable Occupational Safety and Health Administration <br />(OSHA) and Environmental Protection Agency (EPA) regulations, including tank construction, <br />placazding, secondary containment provisions, approved tanks, and operating equipment. No oil <br />or lubricants shall be drained on the ground and no burning of waste is allowed. No bore holes <br />shall be used for disposal of waste materials. Human waste shall be contained and shall be <br />disposed of at an approved sanitary landfill. <br />23. Noise leveis will be at or below the acceptable stnadazds set by the Mine Safety and Health <br />Administration (MSHA) and the Occupational Safety and Health Administration (OSHA). <br />lusher will be placed strategically along with stockpiles to minimize noise. <br />24. United will follow dust control procedures outlined in their operations plan and as required <br />under their State Health Dept. perntit and their Mesa County Conditional Use Permit.
