<br />(b) The property in Section 3i, Township 1 North,
<br />Range 80 WeBt; in Sections 34 and 35, Township 1
<br />North, Range 91 west; and in Sections i, 2, 3, 4,
<br />9, S0, li and 12, Township 1 South, Range 81 west,
<br />of the 6th P.M., conveyed contemporaneously
<br />herewith eo the trustees of the Yust Children's
<br />Trust, so long as he shall annually pay to the
<br />truetee(s1 of the Trus[ by April 15 of each year,
<br />ore-half (1/2) of the zeal property taxes on that
<br />portion of the property located in Township 1
<br />North, Range 81 hest, and i~ Sections 3, 4, 9 and
<br />lo, Township 1 South, Range 81 west; and all of
<br />the real property taxes on the remainder of the
<br />property, commencing with the 1994 real property
<br />taxes due and payable in 1995.
<br />(4) All water and water rights, and ditches and ditch
<br />rights, whether decreed or not, used upon or in
<br />connection with [he property conveyed by this deed, and
<br />specifically, Sut not by way of limitation thereof, the
<br />following adjudicated water rights:
<br />the Griggs Ditch, diverting water from Beaver
<br />Creek No. 2, Priority No. 9, Ditch No. 9, with
<br />Priority Date of April 30, 1681, for 6.00 e.f.s.;
<br />and
<br />The Loback Ditch, diverting water from Blue River,
<br />Priority No. 243, Ditch No. 228, with Priority
<br />Date of Deeembes 31st, 1930, for 18.3? e.f.e.
<br />The 3.o efs allowed to flow therein pursuant to
<br />Decree sneered nareh 10, 1952 in Summit County
<br />Di9triet Court Civil Action No. 3805, recorded in
<br />Book 241 at Page 6'9 of the Grand County secarde,
<br />and any and all rights of Grantors pursuant to the
<br />terms of Contract dated September 7, 1945,
<br />recorded in gook 92 at Page 439 of the Grand
<br />County records, between the United States and Earl
<br />J. Martin and Frank Edward Yust.
<br />TOGETHER W1TH all easements, rights-of -way, ditches,
<br />ditch embankments, flumes, headgatea, measuring
<br />devices, sad any other structures or rights appurtenant
<br />eo said water rights.
