C- <br />0125439, C-0125515 and C-0125516, and a pazcel of fee land. Said LMU is subject to (1) the <br />Resource Recovery and Protection Plan (R2P2) as revised October 20, 2000 and filed with the <br />Bureau of Land Management and (2) the Royalty Rate Reductions Decision granted by the <br />Bureau of Land Management April 17, 2002 and effective January 1, 2000. <br />The above described federal coal leases are collectively referred to as the "Federal Coal Leases." <br />Agreement dated September 11,1992, by and between Sheridan Enterprises, Inc., a California <br />corporation, and Grand Valley Coal Company, a Colorado corporation, subsequently assigned to <br />Lodestar Energy, Inc. by Deed and Assignment dated July 14, 1999 and recorded in Book <br />2612, Page 976 of the Clerk's office of Mesa County, Colorado and in Book 1141, Page 7 of <br />the Clerk's office of Garfield County Colorado. <br />Assignment and Agreement dated as of September 9, 1992, byardbetween Industrial Assets, Inc., a <br />Coknado corporation, and Grand Valley Coal Company, as amended by Amended and Restated <br />Assignment and Agreement dated October 15, ]992, by azrd between Industrial Assets, Inc., a <br />Colorado corporation, and Grand Valley Coal Company, a Colorado corporation, subsequently <br />assigned to Lodestar Energy, Inc. by Deed and Assignment dated July 14, 1949 and rewrded <br />in Book 2612, Page 976 of the Clerk's office of Mesa County, Colorado and in Book 1141, <br />Page 7 of the Clerk's office of Garfield County Colorado. <br />Lease dated Apri19, 2002, between Ival and Ed Young, Inc. ("Young") and Lodestar Energy, <br />Inc., pursuant to which Young leases to Lodestar aright-of--way between State Highway 139 in <br />Garfield County, Colorado, across the private property of Young into Munger Canyon. <br />The above described pmperiy rights are collectively referred to as the "Property Rights." <br />PRIVATE COAL LEASES <br />The following three leases perTain to various undivided interests iA and to the "Wise Fee Trail" described <br />above and encompassing approximately 160 saes. <br />Jones Coal Lease: Coal Lease dated November 2,1978, between Walter Jones as lessor and William E. <br />Wise as lessee and recorded inBook 524 at Page 502 oflhe Garfield County, Colorado records, as amended <br />by that Ameredmart of Coal Lease dated March 14,1979 and recorded in Book 525 at Page 544 of the <br />Garfield County, Colorado reamrls, and covering the right to mine, develop, process and market opal from <br />certain trails of lazed as described in said Coal Lease and situated in Garfield County, Colorado. <br />
