The grantee shall notify the authorized officer 24 hours prior to <br />start of construction or maintenance activities. <br />Construction <br />2. Construction of all power lines will implement the following Special <br />Stipulations for the protection of raptors: <br />Power line construction and specifications must be in compliance <br />with the following legislation: <br />a) Bald Eagle Protection Act of 1940 (16 U.S.C. 688 as amended). <br />b) Migratory Bird Treaty Act of 1915 (16 U.S.C. 703 as amended). <br />c) Endangered Species Act of 1973 (87 Stat. 1064). <br />. The power line must be constructed to standards which prevent <br />electrocution of large perching birds. To assure this, phase <br />spacing, configuration, and grounding must be of a type which does <br />not present a significant hazard to large perching birds (Rural <br />Electrification Administration (REA) Bulletin 61-10). Sixty-inch <br />spacing is required. <br />The Bureau of Land Management reserves the right to require modifi- <br />cations and additions to all power line structures placed on the <br />right-of-way if determined necessary to insure the safety of large <br />perching birds. Such modifications and additions will be made by <br />the permittee and without liability or expense to the United States. <br />3. All construction activities shall be confined to the minimum area <br />necessary. The exterior boundaries of the right-of-way shall be <br />clearly flagged prior to any surface-disturbing activities. <br />4. All construction activity shall cease when soils or road surfaces <br />become moisture saturated to a depth of three inches unless other- <br />wise approved by the authorized officer. <br />Rehabilitation <br />5. All disturbed areas shall be recontoured to conform with local <br />topography. <br />• 6. Drainages shall not be blocked or filled with loose dirt or debris. <br />
