This water right is subject to a right of reversion in CRSS, Inc. The above <br />described water and water rights were conveyed to Lodestar Energy, Inc. by Deed and <br />Assignment dated July 14, 1999 and recorded in Book 2612, Page 976 of the Clerk's <br />office of Mesa County, Colorado and in Book 1141, Page 7 of the Clerk's office of <br />Garfield County Colorado. Said water rights are also subject to the Assignment and <br />Agreement between Industrial Assets, Inc., and Grand Valley Coal Company, <br />Assignee, dated September 9, 1992 and recorded in the Clerk's Office of Garfield <br />County, Colorado, in Book 846. Page 427, providing for the right of reversion in 10 <br />c.f.s. of water rights in the Mack Plumbing Pipeline to Industrial Assets, Inc. <br />The above described water rights are referred to collectively as the "Water Rights." <br />• <br />
