twenty-two specific items listed in Rule 2, additional
information in the form of maps and exhibits is required.
Rule 2.1.2, entitled Maps and Exhibits, says "all information
required in this section shall be submitted with each of the
application forms." (Emphasis added.) Battle Mountain's most
glaring omission concerns water information.
"Exhibit G - Water Information"- requires an operator to
state whether his operation is expected to directly affect
surface or ground water systems, and if so, to provide specific
information, including, among other things, an estimate of
project water requirements." In addition,
(T]he operator shall indicate the water
rights and sources of water to supply project
water requirements. The sources and the
rights shall be investigated by the Board,
utilizing available sources to obtain the
necessary information in the timely manner
prior to the Board's consideration of the
Rule 2.1.2(8) (emphasis added).
The State's concern over hydrologic impacts of mining
operations is also reflected in Colorado statutes. Mining
reclamation plans must assure that "[d]isturbances to the
prevailing hydrologic balance of the affected land and of the
surrounding area and to the quality and quantity of water in
surface and ground water systems both during and after mining
operation and during reclamation shall be minimized." C.R.S.
§ 34-32-116(7)(8) (1988 Cum. Supp.).
-2-
