Battle <br />Mountain must be required to monitor the secondary recovery and <br />leak detection systems daily throughout the operation of the <br />mine. <br />IV. CONCLUSION. <br />Because the application is neither complete nor <br />adequate, the Hoard should not issue a permit to Battle <br />Mountain. The application fails to adequately provide for <br />protection of human health and the environment. <br />Alternatively, if the permit is granted, it should be <br />conditioned upon Battle Mountain's agreement to certain <br />additional measures recommended by MLRD and CES. The Board <br />must: (1) prevent dewatering of the Rito Seco through <br />construction of an appropriately-sized slurry wall; (2) require <br />reclamation of both mining pits to original contours; (3) require <br />sufficient soil addition during reclamation to assure <br />revegetation; (4) require contouring of waste rock piles to <br />uninterrupted slopes; (5) require monitoring of sulfuric acid <br />generation from the waste rock and tailings; (6) require <br />maintenance of ditch liners and the underlying heap leach liner; <br />(7) require monitoring of the spent heap leach and surrounding <br />-18- <br />
