-~ • • <br />EXHIBIT G <br />Mining Lease <br />Lease made this 8th day of February 1988, between James P. <br />Fassler of the County of Washington, State of Colorado, herein referred to as <br />Lessor, and THE BOARD OF COUNTY COMMISSIONERS OF WASHINGTON COUNTY, COLORADO, <br />a body politic organized under the laws of the State of Colorado, of the <br />County of Washington, State of Colorado, herein referred to as Lessee. <br />Lessor, in consideration of the agreements set forth herein to be kept <br />and performed by Lessee, and of the payment of royalties by Lessee as <br />provided herein, and subject to the terms, conditions, and provisions <br />contained herein, leases to Lessee a tract of land situated in the Northeast <br />Quarter of Section 15, Township 2 North, Range 53 West of the 6th P.M., for <br />the purpose of mining, removing, and marketing therefrom all sand, gravel and <br />rock located within the confines of the gravel pit which will be issued by <br />the Board of Mined Land Reclamation of the State of Colorado, all of which <br />are herein referred to as materials. <br />This lease shall be in effect for a period of 3 yearsfrom <br />February 8 1988 to February 8 ,1991 Lessee shall <br />have the right and option to renew this lease fer successive periods of three <br />}•earseach extending from the termination date of each succeeding year for a <br />to:a_1 of 10 years. <br />Lessee shall pay to Lessor, as royalty, $ ,~ O for each cubic yard <br />of materials removed from the premises. Lessee shall forward to Lessor <br />monthly reports showing the quantity of materials removed during the <br />preceding month, according to truck loads, with dates of loading. Each <br />report shall be accompanied with a check from the Lessor to the Lessee for <br />payment of the preceding month's material. <br />Lessee may clear brush and undergrowth from such portions of the leased <br />premises as may be reasonably necessary to explore for materials or to locate <br />pits, quarries, and stockpile areas. Lessee shall have the right to make use <br />of all roadways presently existing on the leased premises, and shall have the <br />further right to build such additional roads as may be necessary for the <br />production and removal of materials hereunder. <br />In digging pits for the purpose of producing and removing materials <br />hereunder, Lessee agrees to make separate stockpiles of topsoil and of waste <br />substances. Lessee agrees that on the completion of the removal of materials <br />from the pits that have been dug on a leased premises, Lessee will place any <br />unused waste substances and materials used for roadways back into the pits <br />from which such substances and materials were removed, with topsoil placed on <br />top, and Lessee will back-slope such pits, using such substances and <br />materials as have been removed from such pits. The restoration of the <br />surface shall be in accordance with the rules and regulations promulgated by <br />the Mined Land Reclamation Board of the State of Colorado. <br />
