MMRR Quarry, M-2004-067 <br />Response to June 30 Adequacy Review (as amended) <br />August 19, 2005 <br />Page 3 <br />the access permit will be forwarded to the DMG as soon as available. All <br />drawings depicting the access point (e.g., C-2A, C-2B, C-2C, C-2D, and F) have <br />been revised and are enclosed for review purposes. <br />RESPONSE TO ADEQUACY COMMENTS <br />A detailed response to technical review comments is provided below, with <br />reference to numerous other reports and site-specific studies. Where the <br />Division's comments were revised by the letter dated August 2, 2005, the <br />italicized text below reflects this latest version of the adequacy comments. <br />1. In conformance with Rule 1.4.1(a), please provide a revised Regular 112 Operation applicabbn <br />form which lists the revised permitted acreage, affected land acreage, legal description, and <br />primary mine entrance location based on the new site access location along Highway 119. <br />As noted above, this submittal includes a technical revision to the mining plan, <br />eliminating the new access point as located in the March 23, 2005 applicant <br />materials. The access point included on the current plans is substantially similar <br />to the location in the application of November 2004. An adjustment of the access <br />road driveway centerline approximately 106 feet to the northwest is the result of <br />detailed review of a new access permit by CDOT and Gilpin County's Road and <br />Bridge Department. The current plan, including the access point, are consistent <br />with all information and certifications provided by the applicant on the application <br />form submitted in November 2004. <br />Exhibit A -Legal Description <br />2. In conformance with Rule 6.4.1(1), please provide a revised Exhibit A -Legal Description for <br />all proposed affected lands, including the revised site access location. <br />The legal description of the permitted area has remained unchanged throughout <br />the M-2004-067 review process. To the nearest quarter section, affected lands <br />include the Northeast Quarter and the Southeast Quarter of the Northwest <br />Quarter; the Northwest Quarter and the Southwest Quarter of the Northeast <br />Quarter; and the Northwest Quarter of the Southeast Quarter, all in Section 26, T <br />3 S, R 72 W, 6th P.M. <br />The driveway access location is, as noted in response to Item 1 above, <br />effectively the same as the location initially proposed. This driveway location is <br />described in latitude and longitude as lat. 39.76639 (deg) N, long. 105.41278 <br />(deg) W. <br />
