Page 53 <br />Construction Materials Rule 2 <br />(d) In the case of any other action for which a written <br />petition for a heazing is timely submitted by a pazty, .the Pre-hearing <br />Conference, if held, shall be held at least fifteen (15) working days prior <br />to the Board meeting scheduled to hear the matter. Unless notice is <br />waived in writing by all parties, the Office shall provide all parties at <br />least thirty (30) days notice of the Formal Board Hearing date. <br />(2) . .The Pre-hearing Conference Officer shall cause to be drafted a <br />Pre-hearing Order. The Pre-hearing Order shall be mailed to all parties to the <br />Hearing within ten (10) working days after the Pre-heazing Conference. <br />(3) The Pre-hearing Order shall include: <br />(a) a list of the parties and their names, addresses and phone <br />numbers; <br />(b) a recommended list of issues .to be considered by the <br />Board at the Formal Board Hearing; and <br />(c) a schedule for the hearing with time allotments set for <br />presentation by each party and the Office. . <br />2.7.2 Board .Consideration of the Pre-hearing Order <br />At the Formal Boazd Hearing on a matter for which aPre-hearing Conference <br />was held, the Pre-hearing Conference Officer or a representative of the Pre- <br />hearing Conference Officer shall present the Pre-hearing Order to the Boazd for <br />its consideration. The $oard-shall consider any timely filed motions regarding <br />the Pre-hearing Order submitted by a party, as well as any changed <br />circumstances ielated to the Formal Board Hearing arising subsequent to the <br />Pre-heazing Conference, and shall subsequently adopt, amend and adopt, or <br />rejecrtheFre-hearing Order. If the Pre-hearing Order is rejected by the Board, <br />the Chair of the Board shall direct the Formal Board Hearing oa the matter. <br />2.7.3 Parties Rights and Responsibilities <br />(1) According to the provisions of Section 244105, C.R.S., party <br />status at.a Formal Board Hearing entitles a party to present evidence, call <br />
