Cottony <br />Aping Division Director <br />The Colorado Division of Minerals and Geology (DMG) has received your objection to the Moffat County Sunbeam #1 <br />112 Reclamation Permit application. Therefore, in accordance with Rule 2.7.1 of the Construction Materials Rules and <br />Regulations of the Colorado Mined Land Reclamation Board (MLRB), a Pre-Heazing Conference has been scheduled [o <br />occur on August 16, 2002 a[ 9:00 am. As we discussed by telephone on Friday, July 2b, 2002, the conference will be <br />conducted by a conference call with you, a DMG representative, and the applicant in Craig. Ms. Sandra Brown will preside <br />as the Pre-Heazing Conference Offices She and representatives from [he Attorney General's Office for the DMG and [he <br />MLRB will pazticipate in the conference via conference call from Denver. <br />The purpose of [he Pre-Hearing Conference is [o describe [he Office's review process, [o explain the rights and <br />responsibilities of parties, to discuss and resolve issues to the extent possible, [o describe [he Boazd Hearing processes, [o <br />determine the list of issues under [he Board's jurisdiction and [o simplify the list, and to determine who has demonstrated <br />standing to be a party to the Formal Board Hearing. <br />The staff will schedule this matter for a Formal Public Healing before [he Colorado Mined Land Reclamation Board. It is <br />anticipated [he [his Hearing will be held on September 18 or 19, 2002. You will be notified of a more precise time when <br />this item is scheduled. <br />Please review the enclosed informational memo, dated October 2, 2001, RE: Citizen Participation in the 112 Reclamation <br />Permit Application Process Revised October 19, 2001, and complete either of [he last two pages, if applicable, and return <br />any completed forms [o [he DMG or bring [hem [o the Pre-Hearing Conference. Also, please note, as described in Rule <br />2.7.1(4) of the Construction Materials Rules and Regulations, that "Any party [hat does not attend [he Pre-hearing <br />Conference forfeits their pazty status and all associated rights and privileges, unless such party provides a fully executed <br />proxy authorization form to the Pre-hearing Conference Officer and the parties' authorized representative is present. <br />However, a party may attend the Pre-hearing Conference via telephone if such a request is made to the Pre-hearing <br />Conference Officer, or a representative, at leas[ five (5) working days prior [o the scheduled Pre-hearing Conference date, <br />and facilities at the site of the Pre-hearing Conference allow for a conference call.° <br />If you have any questions about the Pre-Hearing Conference, or any other matters, please feel free to contact me at (303) <br />866-4062. <br />Siy, <br />Gregg R~quire ~ <br />Environmental Protection Specialist <br />Encl.
