The Division of Reclamation, Mining and Safety has received comments from the Office of County
Engineer, Delta County. (Attached) Please address the County comments and issues directly to E. Leroy
Black, County Engineer as noted in the document. Dirt Merchant Construction should Cc a copy of
their response to the Division for the permit file as well.
The Division, can and will finish it review process and issue a decision as required by State Law and
compliance with the Mined Land Reclamation Board Order issued on June 14th, 2006. However, Dirt
Merchants must be made aware that no further disturbance maybe initiated until the applicant supplies
the Division with documentation from the County of either a waiver or permit being issued. Should
such documentation not be forthcoming from the County, Dirt Merchants will be required to reclaim the
area as approved by the Division permit for the current disturbance area with no further excavation
being allowed.
