Box 106 <br />Lake George, Colorado 80827 <br />RE: Process to Appeal Division Decision, Twin Creek Campground, <br />The Clare Corporation, File No. M-89-044 <br />Dear Mr. Pearce: <br />We received your letter of objection to the above-referenced permit <br />application on June 8, 1989, This letter was received within the public <br />comment period and has been forwarded to the applicant, <br />The Mined Land Reclamation Division must make all approval or denial decisions <br />for Section 110 permit applications, The decision must be made within 30 days <br />after the filing of an application, unless an applicant waives his right to <br />the 30 day decision deadline. The applicant has requested to waive a decision <br />until July 14, 1989. <br />The operator or any person who submitted statements of support or objection <br />during 'the public conment period may appeal the Division's decision to the <br />Board. A request for Administrative Appeal must be submitted to the Division <br />within sixty (60) davs of the decision date. The request for Administrative <br />Appeal roust include the permit file number and all factual and legal questions <br />which tfle Applellant wishes to have the Board decide. If a request for <br />Administrative Appeal is received, the Board, at its next regularly scheduled <br />meeting., will review the request and, if it finds good cause, shall seta date <br />for a hfaaring on the issues raised by the request. Rules 3.2(4)(c) and (5) <br />contain more information about the decision and appeal processes. <br />You will be notified of the Division's decision on this application after the <br />decision date. <br />If you Have any questions, Dl ease contact me. <br />Sincerely, <br />John T.
