distance of 1073.76 feet along the t9est line of the <br />~ Northeast Quarter of the Southwest Quarter; 'I7~ence <br />~ South 89°53'40" East a distance of 3970.88 feet <br />alony the North line of the Northeast Quarter of the <br />Southwest Quarter, and the Northwest Quarter of the <br />Southeast Quarter and the Northeast Quarter of the <br />Southeast (~>arter to the point of beginning. <br />Said parcel includes Irrigation Well Reg. #29-11874, <br />R.F. 200, forming a part of the Larimer-Weld Augmenta- <br />tion Plan. <br />WHEREAS, the petitioner was present, and <br />WHEREAS, evidence was presented in support of the granting oC <br />the Special Use Permit for an open cut mining permit for gravel <br />on the above described real estate, and <br />WHEREAS, Section 3.3(E)(2) of the Weld County Zoning Resolu- <br />tion authorizes such a use in an Agricultural District upon appro- <br />val by the Board of County Commissioners, and <br />t41iEREAS, the Board of County Commissioners of Weld County, <br />Colorado, heard all the testimony and statements of those present, <br />has studied the request of the petitioner and the recommendations <br />of the Weld County Planning Commission and all of the exhibits and <br />evidence presented in this matter, and having been fully informed <br />and satisfied that the request for a Special Use Permit for an <br />open cut mining permit for gravel on the hereinabove described <br />real estate, conforms to the purposes of Section 3.3(E)(2) of the <br />Weld County Zoning Resolution. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- <br />missioners of Weld County, Colorado, that the application of the <br />petitioner for a Special Use Permit for an open cut mining permit <br />for gravel on the hereinabove described tract of land, be and <br />hereby is, granted subject to the Development Standards and the <br />operational Standards contained in the Special Use Permit and <br />also that an additional operational standard be included requiring <br />that upon completion of the mining of Phase III and the first <br />pond to the west, that an agreement be drawn between the City <br />of Greeley and the developer to protect the public usage of the <br />City of Greeley property north of the river. <br />BE IT FURT1iER RESOLVED by the Board that the reasons for <br />
