File No. 0-99-043 :~-- <br />m -ao~o -o ~a <br />Deaz Mr. and Mrs. Goode: <br />The Division has reviewed the information you supplied us in your November 2, 1999 <br />correspondence. It is the Division's opinion, based on that correspondence, that a Mined Land <br />Reclamation Board permit will be needed if you excavate into the surface. If you plan to only <br />remove surface moss rock and leave only slight depressions, then a MLRB permit would not be <br />required. The defining factor is whether the removal activities in total will cause more than <br />incidental surface disturbance. I have attached a copy of the Boazd's policy for your review. <br />The Board has requested that the Division make determinations as to the need for a Mined Land <br />Reclamation Board Permit. Please be awaze [hat the Division's determination that a permit is or <br />is not needed, is simply the Division's opinion and can be challenged by any party at a heazing <br />before the Mined Land Reclamation Board. If you wish a Board determination, you should <br />request a Declazatory Order hearing with the Mined Land Reclamation Boazd by notifying this <br />office. <br />Respect lly, <br />H.
