<br />IJIiERL•AS, BETTGEP. SAND AND GRANGE desires to conduct an open mining opera-
<br />tion, known as Lower Hogue Pit, for the pnrnose. of extracting, open mined sand and
<br />gravel; and
<br />411;hRE.1S, the ;lined Land Ra:lamaCion hoard has rec~•ic~.d mi application, a
<br />rocluni.ition plan ar,d map, the required fee, and a bond or suraty for such operation
<br />as required by law; and,
<br />l+q{ERIiAS, the ifined Land Reclamation P,oard has made a finding, for the pur-
<br />poses of issuing this permit, that:
<br />1) the application complies with the requirements of the Colorado
<br />Mined Land Peclamation Act and all applicable local, stag and
<br />federal Laws; and,
<br />2) the operation will not- adversely affect the stability of any
<br />significant, valuable, and permanent man-made structures located
<br />within two hundred feet of the affected land, except inhere there
<br />is an agruement between the operator and the pe!:sons having an
<br />interest in the structure that damage to the strucCUre is to be
<br />compensated for by the operator; and,
<br />3) the proposed mining operations and reclamation can be carried out
<br />in confurn:ance with the requirements of C, R. S. 1973, 34-32-116,
<br />ss amended (1976 Sess. Laws H,B. 1065); and
<br />IdHEREr1S, for the purposes of issuing this permiC, the operator has made
<br />a satisfactory showing to the Board that lie will employ during and after his
<br />open mining operations procedures reasonably designed to minimize as much as
<br />practicable the disruption from the open mining operations and will provide for
<br />the rehabilitation of the affected land through the rehabilitation of plant cover,
<br />soil stability, water resources, and other measures appropriate to the subsequent
<br />beneficial use of such mined and reclaimed lands; and that in the event of the
<br />failure of his proposed reclamation plan, he will take whatever measures which
<br />may be necessary in order to assure the success of reclamation of tine lands af-
<br />fected by his open mining operations; and,
<br />[JHEFEAS, for the purposes of issuing this permit, a copy of tt~e application
<br />approved by the Alined Land Reclamation Board of the State of Colorado is attached
<br />to this permit and thereby becomes a part of the terms hereof.
<br />NOIJ, THEREFORE, pursuant to the authority se[ forCh in the Colorado Alined
<br />Land Reclamation Act, :lrticle 32 of Title 34, C,F,S. 1973, as amended, (1976 Sess.
<br />Laws H, B, 1065) the Pained Land Reclamation Board of C;ie State of Colorado hereby
<br />issues a life cf the mine permit to L'GTT'GER SAND AA1D GRAVEL to engage in open
<br />mining for the purpose of extracting open mined sand and gravel on the following
<br />parcel of grcucd, to wit: six acres contained in: Slit' S4!l; of SecCion 4, T6::,
<br />RSSiJ of the 6th P.I.1, as indicated on the Aline Plan Ptap in the permit Cile, subject
<br />to the fo1lo~.aing special conditions:
