is the ~~sserted failure to timely file a copy of such appli-
cation with the clerk and recorder of LaPlata County. again,
plaintitFfs cite C.R.S. 1973, 34-32-112(10)(x) which is appli-
cable to major mining operations. The requirements of 34-32-112
governing notice and procedures generally are incorporated
into the provisions governing small mines only in general
terms, ~:ubject to the admonition that "simplified and reduced
procedures and requirements" must be followed in such cases.
C.R.S. 1973, 34-32-110(7).
Furthermore, the third procedural challenge must fail
because the statute does not specify a deadline for filing
a copy of the permit application with LaPlata County but
merely ~:tates that it shall be so filed "upon the filing of
the application" with the board. Tne failure to file with
LaPlata County immediately after filing with the board was
due to Spillers' unfamiliarity with the Mined land Recla-
mation acct and was remedied promptly when called to his
attention. Late filing with the county certainly has not
prejudiced plaintiffs.
4. The fourth alleged irregularity which plaintiffs
contend is fatal to the permit application is the failure
by the board to set down for a formal adjudicatory hearing
- 7-
