The Spillers mining application was not filed under <br />G.R.S. 1973, 34-32-112• which is applicable only to major <br />surface mining operations. The permit was applied for under <br />34-32-110 which applies to limited impact operations, being <br />small (less than ten acres) mines. Under the latter section <br />the board is required to conduct "simplified and reduced <br />procedures and requirements...." to meet a statutory mandate <br />tnat applications for small mining operations be processed <br />in the <.;hortest possible time. C.R.S. 1973, 34-32-110(7). <br />The two-•day delay in commencing publication was in no way <br />prejudicial to plaintiffs, who duly filed objections to the <br />Spillers application, appeared and vigorously pursued such <br />objections at the agency level. <br />Nhere a statute specifies a time period within which <br />an act is to be done, failure to make the deadline does not <br />necessarily render the action fatally defective unless the <br />statute so provides. The purpose of such statutes is to <br />urge expedition upon those responsible for carrying out <br />legislative commandments. but the commandments themselves <br />are directory only, not mandatory.
