Long <br />Divninn Uir,~uv <br />The Division will schedule your December 22, 1993 request for administrative appeal before <br />the Mined Land Reclamation Board during the January 26-27, 1994 meeting. If the Board <br />decides to approve your request and proceed with the appeal the Division will schedule the <br />matter as a.Formal Public Hearing at the February 23-24, 1994 meeting. You may contact me <br />at 866-3567 during the afternoon of January 24, 1994 to determine the date and time of the <br />meeting. <br />As you may recall, the Board conditionally approved the 112 application on <br />December 15, 1993. The conditions of approval were: <br />1. the maximum allowable disturbance is 108.2 acres; and <br />2. Mid-Western Farms may not begin mining until the have supplied evidence to <br />the Colorado Attorney General's office of a redeemed tax certif-irate that clearly <br />demonstrates Mid-Western Farms as the legal owner of the surface and mineral <br />rights of the 1,470 acres in question. <br />Sincerely, <br />~,~„^-e-o ~, <br />"Thomas A.
