f y. <br /> <br />Mr. Don Mazostica <br />May 16, 2000 <br />Page Two <br />R'e are aware that the site plan, dated October 18, 1995, which you and the City of <br />Loveland provided to us, shows floodway, and floodplain lines, that aze substantially <br />different from the lines depicted on [he current FEMA map referenced in the previous <br />paragraph. On the site plan there is reference to a "Current Floodway," "100 year Flood <br />Plain Limit," and "500 Yeaz Flood Plain Limit." These reference a study, conducted in <br />1981 by Resource Consultants, Inc., a study that was never officially recognized by <br />FEMA, the City of Loveland, or Larimer County, as being the regulated limits of the <br />floodway or floodplain. We have contacted FEMA, Larimer County, the City of <br />Loveland, and the consultant to whom you referred us, Mr. Dan Gregory, of ENSR, and <br />have determined that the regulated floodway, as recognized by all of these entities, is the <br />one depicted on the FEMA map dated 1979; consequently it is that information that we <br />aze using as the basis of our current study. Furthermore, a line on your site plan <br />identified as "Floodway Boundary fora 1.0' surcharge as modified by Consultant" is not <br />recognized by the entities named above as being a regulated limit, and as far as eve have <br />been able to determine through contacting the consultant and government agencies, has <br />never been modeled to show its feasibility. <br />We expect that the study currently underway at Simons & Associates will be complete <br />within the next hvo weeks. At that time, we will modify our current mining and <br />reclamation plans, if necessazy. We will be meeting with adjacent property owners to <br />share the results of the study and respond to their concerns. We appreciate your interest <br />in this matter and will be contacting you soon to arrange a meeting.
