• 7. WATER RIGHTS ISSUES
Since the pond is designated as an Erosion Control Dam in the Division of Water Resources
regulations and since it will not contain more than 2.0 acre feet below the principal spillway pipes
(6" sections), no water rights issues exist. The landowner Burbridge has secured water rights for
the irrigation operation but does not intend to use these rights for expanding Pond 008.
