SHELTOH, Director <br />County, City, and Town Zoning <br />MEMORANDUM <br />DATE: February 12, 1987 <br />T0: Rio Grande County Planning Department <br />Box 160 6th & Cherry <br />D Norte 0 <br />FROM: r] Mou t, Reclamation Specialist <br />Pursuant to the requirement of the Colorado Mined Land Reclamation Act* to <br />inform counties and certain municipalities of mining and reclamation permit <br />applications filed with this office, please know that Rio Grande County has <br />filed to conduct surface mining at or near Section 27.0, Township 40.0 N, <br />Range 4.0 E, 10th Prime Meridian. The applicant proposes to reclaim the site <br />for rangeland. <br />The Mined Land Reclamation Board must deny a permit for any proposed mining <br />operation which would be in violation of zoning, subdivision regulations or <br />any master plan for extraction (See C.R.S. 34-32-115(4)(e)). Similarly, the <br />Board cannot grant a permit for a new mining operation if the operator's <br />reclamation plan for an area is inconsistent with an adopted plan by any <br />county, city and county, city, or town unless a prior declaration of intent to <br />change or waive the prohibition is obtained by the applicant from the affected <br />government subdivisions (See C.R.S. 34-32-109(8)). Please return the enclosed <br />form to provide this critical information. <br />The applicant is required to place a copy of the application for public <br />inspection with the Clerk of the county in which the proposed mine is <br />situated. This is intended to provide the application for public review and <br />comment. Please note that it is not intended to be made a part of public <br />record by recording. <br />The Board is tentatively scheduled to consider this application on February <br />-2B' 1987. <br />~~ <br />We appreciate your cooperation in this matter.
