`1 ~ • • <br />This exhibit states [hat there are no[ any permanent man-made structures on the Timnath <br />Connell Site. I[ appears that [he fence lines and possibly the roadways of I-25 may be within <br />200 feet of the proposed disturbed area. Also, as noted in adequacy review item No. 2. above, <br />the Box Elder Ditch is a permanent man-made structure located on the site. <br />Please address Rule 6.4.19. The applicant may either: <br />(a) provide a notarized agreement between the applicant and the person(s) having <br />an interest in the structure, that [he applicant is to provide compensation for any <br />damage to the structure; or <br />(b) where such an agreement can not be reached, the applicant shall provide an <br />appropriate engineering evaluation that demonstrates that such structure shall <br />not be damaged by activities occurring at the mining operation. <br />5) Rule 6.2.1(2)(b) requires that maps, except the index map, must conform to the following <br />criteria: <br />"(b) must be prepared and signed by a registered land surveyor, professional <br />engineer, or other quali5ed person;" <br />Please provide two copies of all required maps with [he appropriate signatures. <br />6) Enclosed is a June 21, 1999 memo from Allen Sorenson to Gregg Squire, RE: Reservoir Lining <br />Plan, Connell Resources, Timnath Connell Pit, File No. M-99-050. <br />Please address the issues identified in this memo as part of the Timnath Connell adequacy <br />review. <br />Please respond to these review items by July 19, 1999 in order to give the Division time to review your <br />material. <br />If you have any questions, please contact me or Allen Sorenson. <br />Sincerely, <br />,n <br />i ~ ~ <br />Gregg .
