OF MINERALS <br />8 GEOLOGY <br />RE: Washington County, Hayes Pit, File No. M-98-065, Corps File No. 199880644 <br />Dear Mr. Mount: <br />Reference is made to Hayes Pit located in Section 32, Township 3 North, Range <br />50 West, Washington County, Colorado. <br />The project has been reviewed in accordance with Section 404 of the Clean Water <br />Act under which the U.S. Army Corps of Engineers regulates the discharge of dredged <br />and fill material, and any excavation activity associated with a dredge and fill project, in <br />waters of the United States such as streams and wetlands. Based on the plans presented, <br />this project will not require a Department of the Army (DA) permit. <br />Although a DA Permit will not be required for the project, this does not eliminate <br />the requirement that other applicable federal, state, tribal, and local permits be obtained if <br />needed. <br />If there are any questions concerning this matter, please call Mr. Terry McKee of <br />this office at 303-979-4120 and reference Corps File No. 199880644. <br />Ctl <br />Cinrarrly <br />
