Cottony <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology has begun the review process for the above referenced 112c <br />application. APre-operational inspection was conducted on January 11`h, 2006 with Mr, Kerr from <br />United /Old Castle. The review and inspection have generated the following issues that require <br />correction or clarification. Please address the following: <br />1) It is noted that the sedimentation pond will be constructed at the beginning of the mining <br />operation. The plan calls for the construction of a riprap spill-away for water headed towards the <br />river. Staff requests a commitment for the construction of this spill-away prior to initial use, <br />2) How will access to the settling pond be maintained through out the Life of the mine? Will access <br />be necessary for initial construction? <br />3) It appears that some reclamation will be required around the settling pond area that is not <br />addressed in the plans. The Reclamation Map notes this area as undisturbed vegetation, which is <br />not correct. Please clarify the final disposition of the pond and surrounding area. <br />4) The Mining Plan calls for a buffer zone between any highwall and the permit boundary edge. <br />The buffer will be mined at 3:1 to ensure proper slopes at the end of mining. Please commit to <br />the marking of the buffer zone prior to initial mining operations to ensure that highwall <br />excavation does not extend beyond the commitment area. <br />5) The Mining Map shows the entrance ramp coming into Phase 5 and as conceptual as it will <br />change as mining conditions change. However, during the Pre-Operational inspection the ramp <br />was noted as probable being located on the upper terrace near the lined pond to begin with. Staff <br />would like a clarification of the location point for the ramp at the start of operations. It is <br />understood that it will change in time. The second related issue is how does the operator intend <br />to start operations in Phase 1 and 2 while the entrance is going to go through 4 and or 5? <br />Impacts such as the construction of a haul road, etc. must be accounted for within the <br />reclamation bond calculations. <br />6) The Reclamation Plan calls for concurrent reclamation of Phase 1, as Phase 2 is mined and so on. <br />Staff requests a commitment that slopes will be seeded as described in the Reclamation Plan at <br />the time of slopes are established.
