There's been concerns raised about sedimentation of <br />the Rito Seco, which I briefly touched on, which we <br />feel would be mitigated by the use of the sediment <br />traps below each of the major facilities by the uses <br />of ditches and beams adjacent to the haul roads and <br />the other facilities. <br />Testimony of Steve Renner, MLRD staff, Vol. 2, page <br />189. <br />6. Steve Renner described the location ~of the <br />facilities with respect to the 100-year flood <br />plain. Both Battle Mountain's and the Colorado <br />Water Conservation Board's flood plain studies <br />indicated that the mine facilities, with the <br />exception of a portion of the haul roads would <br />be outside the flood plain. Vol. 6, pages 189- <br />190. <br />Following these comments by the Board's staff the Board <br />conducted extensive questioning of the staff to determine impacts <br />from the mining operation on water quality and water quantity. <br />Vol. 2, pages 195-201. <br />At the March 22, 1989 hearing the Board received additional <br />testimony describing how water quality disturbances by the project <br />would be minimized including: <br />1. Additional testimony by Steve Renner, MLRD, <br />describing facility operation including <br />discussion of the dual liners under the heap <br />leach system, enclosure of all cyanide process <br />water lines in lined trenches and design of the <br />ponds to contain all water from the heap and <br />the 100 year, 24 hour storm event. Vol. 3, <br />pages 455-456. <br />2. The Board asked the Division to discuss the <br />legal basis for requiring Battle Mountain to <br />submit an emergency response plan. Fred Banta, <br />Director of MLRD, responded that the plan was <br />required under statutory authority to minimize <br />- 15 - <br />
