Box 307 <br />San Luis, Colorado 81152 <br />~E~E~VED <br />January 2, 1969 <br />Mined Land Aeclamation Board <br />Dept. of Natural Resources, State of Colorado <br />215 Centennial Bldg., 1313 Sherman St <br />Aenver CO 60203-2273 <br />Gentlemen: <br />JAN C 196g <br />RECLq INED LAND <br />MATION DIVISION <br />The Costille County Committee for Environmental Soundness <br />respectfully requests that the U.S. Army Corps of Engineers notify <br />the Battle Mountain Gold Company that they will be required to <br />obtain a permit under Section 40q of the Federal Clean Water Act. <br />It is conceivable that the company, in order to obtain such a <br />permit, xill have to make significant changes in its proposed mining <br />program and the 112 Permit application. <br />In addition, it is likely that issuance of e 404 permit xi:.l <br />require preparation of en Environmental Impact Statement (EIS), a <br />document that will provide substantial additional information to the <br />Mined Land Reclamation board, other state and local agencies, avid <br />concerned citizens. Without the information an EIS xi11 provide:, it <br />will be impossible for the Board, or any other responsible groui~ or <br />individual to make an informed decision about the short or long term <br />implications of this proposed operation. <br />Theretore, we formally request that the board defer any aci:ion <br />on the 112 Permit until the Corps of Engineers has determined <br />whether they recuire a 404 Permit. further, ii the Corps of <br />Engineers does require a qD4 permit, the Board should defer any <br />action until they have the benefit of the prepared and issued <br />Environmental impact Statement. <br />He would appreciate hearing from you soon. <br />Sincerely, <br />i <br />Joseph G.
