Goss' "Goss Sand and Gravel" -File No. M-85-140, E1 Paso County <br />Dear Mr. Brown: <br />Please find the date-stamped copy of the "Protest and Petition for Hearing" <br />letter delivered by your courier and received by the Division on November 12, <br />1985. Pursuant to CRS 34-32-114 a copy of the "Protest and Petition for <br />Hearing" letter was transmitted to Mr. Goss. <br />Historically, the Colorado Mined Land Reclamation Board has not considered <br />Water Rights/Laws as they have no jurisdiction over Water Laws, but have <br />directed Water Law issues to the State Engineer's office, Division of Water <br />Resources. <br />It may be to your best interest to withdraw the request for a hearing, and <br />pursue the resolution of the issues with the Division of Water Resources. <br />If you choose to petition for a hearing, the Division will recommend that the <br />request be denied, as the Division of Water Resources, NOT the Colorado Mined <br />Land Reclamation, has jurisdiction over Water Laws. <br />If you have any questions, please not hesitate to contact me. <br />Sincerely, <br />~nL,,000 7j~. ~c ~,.[LC. <br />Camille M.
