<br />THIS DEED, made this 17th day of April, 1985, between JOHN D. VON
<br />BERNUTH of the County of Rio Grande and State of Colorado, of the first part,
<br />and RIO GRANDE COUNTY whose legal address is Rio Grande County Courthouse, Del
<br />Norte 81132 of the County of Rio Grande and State of Colorado, of the second
<br />part:
<br />WITNESSETH, That the said party of the first part, for and in
<br />consideration of the sum of TEN DOLLARS ($10.00) AND OTHER GOOD AND VALUABLE
<br />CONSIDERATION, to the said party of the first part in hand paid by the said
<br />party of the second part, the receipt whereof is hereby confessed and
<br />acknowledged, has granted, bargained, sold and conveyed, and by these presents
<br />does grant, bargain, sell, convey and confirm unto the said party of the second
<br />part, its heirs, and assigns forever, all the following described lot or parcel
<br />of land, situate, lying and being in the County of Rio Grande, and State of
<br />Colorado, to-wit:
<br />A parcel of land located in the S~ SEA Section 21, T. 40 N., R. 6 E.,
<br />N.M.P.M., Rio Grande County, Colorado, containing 25.56 acres, more or
<br />less, which parcel is more particularly described by metes and bounds
<br />as follows, to-wit: Beginning at the southeast corner of the parcel
<br />herein described, a point on the northerly limit of the right of way
<br />for Colorado State Highway No. 374, identical with the southwest
<br />corner of that certain tract of land described in Book 358 a[ Page 14
<br />of the records in the office of the Rio Grande County Clerk and
<br />Recorder, whence the southeast corner of said Section 21 bears S. 81°
<br />30' E., 228.50 feet distant; thence S. 88° 24' W., 1117.85 feet along
<br />the northerly limit of said highway right of way to the southwest
<br />corner of the parcel herein described; thence N. 0° 20.5' W., 1185.02
<br />feet to the northwest corner of the parcel herein described, a point
<br />on the southerly limit of the right of way for Lateral No. 1 of The
<br />Rio Grande Canal System; thence S. 73° 48' E., 1136.47 feet along the
<br />southerly limit of said canal right of way to the northeast corner of
<br />the parcel herein described, which corner is identical with the
<br />northwest corner of said tract; thence S. 2° 16' E., 837.43 feet along
<br />the west line of said tract to the place of beginning TOGETHER WITH
<br />all oil, gas and other mineral rights in, upon and under the above
<br />described property.
<br />TOGETHER with all and singular the hereditaments and appurtenances
<br />thereunto belonging, or in anywise appertaining, the reversion and reversions,
<br />remainder and remainders, rents, issues and profits thereof; and all the estate,
<br />right, title, interest, claim and demand whatsoever of the said party of the
<br />first part, either in law or equity, of, in and to the above bargained premises,
<br />with the hereditaments and appurtenances.
<br />TO HAVE AND TO HOLD the said premises above bargained and described,
<br />with the appurtenances, unto the said party of the second part, its heirs and
<br />assigns forever. And the said party of the first part, for himself, his heirs,
<br />executors, and administrators does covenant, grant, bargain and agree to and
<br />with the said party of the second part, its heirs and assigns, that at the time
<br />of the ensealing and delivery of these presents is seized of the premises above
<br />conveyed, as of good, sure, perfect, absolute and indefeasible estate of
<br />inheritance, in law, in fee simple, and has good right, full power and lawful
<br />authority to grant, bargain, sell and convey the same in manner and form
<br />aforesaid, and that the same are free and clear from all former and other
<br />grants, bargains, sales, liens, taxes, assessment, and encumbrances of
<br />whatsoever kind or nature soever.
<br />SUBJECT to any and all easements and rights of way of record, 1985
<br />taxes due in 1986 and the above bargained premises in the quiet and peaceable
<br />possession of the said party of the second part, its heirs and assigns, against
<br />all and every person or persons lawfully claiming or to claim the whole or any
<br />part thereof, the said party of the first part shall and will WARRANT AND
<br />FOREVER DEFEND.
