In the event of a <br />failure of the containment system that causes a leak of the dewatering flow outside the <br />proposed site boundary, the applicant will notify the Division within 24 hours of the leak <br />detection. <br />If, at some puin[ in the future, concerns regarding elevated contaminant concentrations in <br />dewatering flows are determined to be unfounded, the applicant may request, as part of a <br />technical revision to the proposed pernrit, to replace the double-lined containment system <br />with a more conventional system. <br />Prior to any discharge of dewatering flows from the proposed Tanabe site, the applicant <br />will provide a letter to the Division from the Colorado Department of Public Health and <br />Environment (CDPHE), Water Quality Control Division, stating that the applicant has <br />approval to discharge offsite. <br />• In the event of an exceedance of a state water quality standard during offsite discharge of <br />dewatering flows from the proposed Tanabe site, to the extent that the CDPHE must be <br />notified, the applicant will submit a copy of the notice to the Division. <br />Page I <br />11990 Grant St. • Suite 304 • Denver, CO 80233 5441 Boeing Drive. • Suite 200 • Loveland, CO 60536-8855 <br />(303) 452-6611 • Fax (303) 452-2759 (970) 461-9884 • Fax (970) 613-1177 <br />
