The property affected will be a parcel of 9 acres, the 9 acres
located mostly in the Southeast 1/4 of the Northeast 1/4 of Section 19,
Township 6 South, Range 68, West of the 6th Principal Meridian, located
in Douglas County, Colorado. The affected 9 acre parcel is within an
approximate 72 acre parcel owned by the owner, operator and applicant,
James D. Braley, d/b/a Braley Sand 8 Gravel.
The legal description of the larger parcel in which the smaller
effected parcel is located is legally described as:
Situate in the County of Douglas and State of Colorado:
The NEl/4 of Section 19, Township 6 South, Range 68 West of the 6th
P.M.;
EXCEPT the South 660 feet of said NE1/4; and
EXCEPT that portion of said NE1/4 North and East of and including
the Denver Water Board Highline Canal right of way condemned by the
Department of Army Corps of Engineers for the Chatfield Dam, Federal
District Court, Action No. C-1223; and
EXCEPT for that portion of said NE1/4 described by a Deed recorded
December 19, 1968, to Albert C. Enax and Margaret E. En ax, grantees,
in Book 189 at Page 217 in the records of the Clerk and Recorder of
Douglas County; and
INCLUDING the North 20 feet of the NW1/4 of Section 19, Township 6 South,
Range 68 West of the 6th P.M.; and
INCLUDING that portion of Lot 10, Braley Acres, Filing No. 2, more particularly
described as follows:
Starting at the NE Corner of Lot 10; thence South 193 feet; thence
East on a line parallel to the North boundary line of said Lot 10,
a distance of 100 feet; thence North on a line parallel to the West
line of said Lot 10, 193 feet; thence West along the North line of
said boundary to the point of beginning; together with an easement
20 feet wide, measured 10 feet on either side of the center of the
existing water pipeline within Lot 10 and the NW1/4 of Section 19,
Township 6 South, Range 66 West, for operation, maintenance, repair
and replacement of said pipeline, commencing from the existing well
on Lot 10 within that portion of said Lot 10 described immediately
above, across Lot 10 and the NW1/4 of Section 19, Township 6 South,
Range 68 West, East Northeasterly, to the NE1/4 of Section 19,
Township 6 South, Range 68 West, said easement being in length
approximately 391 feet;
AND all of the property conveyed includes the grant and conveyance of
all water wells, all water rights appurtenant, and all mineral and subsurface
rights of whatever kind.
